Terms of Service

These terms are provided as a starting point and should be reviewed by a qualified legal adviser before you rely on them.

The agreement

These Terms of Service are a legal agreement between you (or the business you represent) and Level44 LTD, trading as ComplyWaste (“ComplyWaste”, “we”, “us”), registered in Northern Ireland under company number NI723850, registered address Campsie House, Belfast, Northern Ireland, BT14 8FH. By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.

The service

ComplyWaste is a software service for UK waste firms. It helps carriers create Digital Waste Transfer Notes and helps receivers record DEFRA Digital Waste Tracking / Receipt of Waste records. It comprises a driver app, an office dashboard and this website. We may improve or change features over time.

Accounts and acceptable use

You are responsible for your account and for keeping access to it secure. Sign-in is passwordless, so keep control of the email inbox linked to your account. You agree to use the service lawfully, to provide accurate information, and not to misuse, disrupt, reverse-engineer or attempt to gain unauthorised access to the service.

Subscriptions and billing

ComplyWaste offers a Free plan and paid plans: Solo at £39/month, Crew at £99/month and Fleet at £199/month. Paid plans start with a 14-day free trial. Prices exclude VAT, which is added at checkout where applicable. Billing is handled by Stripe. You can cancel at any time from the billing area; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law.

Not legal or compliance advice

ComplyWaste is a tool to help you record and manage waste documentation. It does not constitute legal, regulatory or professional advice. You remain solely responsible for your own regulatory compliance and for the accuracy and completeness of the information you record, including the correctness of any transfer note or waste receipt you create and submit.

Your records

Waste records you create — Waste Transfer Notes and waste receipts — remain your legal records. We keep them accessible to you for the duration of your account and in line with the retention periods required by law. If your account closes, we'll provide a reasonable means to retrieve or export the records you are required to retain.

Data protection

Our handling of personal data is described in our Privacy Policy, which forms part of these terms.

Disclaimers and limitation of liability

The service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error-free. To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with these terms is limited to the fees you paid to us in the twelve months preceding the event giving rise to the claim. Nothing in these terms limits liability that cannot lawfully be limited.

Termination

You may stop using the service and cancel at any time. We may suspend or terminate your access if you materially breach these terms or use the service unlawfully. On termination, the sections that by their nature should survive — including your records, disclaimers, liability and governing law — continue to apply.

Changes to these terms

We may update these terms from time to time. When we do, we'll revise the “last updated” date above and, where changes are material, give account holders reasonable notice. Continued use after changes take effect means you accept the updated terms.

Governing law

These terms are governed by the law of Northern Ireland, and the courts of Northern Ireland have exclusive jurisdiction over any dispute arising from them.
